一、协议合同协议期限ContractTerm.合约甲方单位机构与合约乙方单位机构签订固定期限劳动协议合同协议本劳动协议合同协议期限为年,自年月日起,至年月日止,其中试用期为个月,自年月日起,至年月日止PartyAandPartyBsignsafixed-termlaborcontract.Thecontractlastsforyearsfromto.Theprobationismonthsfromto;
二、工作有关内容JobResponsibilities.合约甲方单位机构聘用合约乙方单位机构从事岗位工作PartyAemploysPartyBtoengagein..工作地点根据合约甲方单位机构工作需要,经合约缔结双方协调一致,可变更工作地点TheworkplaceiswhichcanbechangedonthebasisofmutualagreementasperPartyAsbusinessrequirements..合约乙方单位机构应积极遵守公司所有规章规章制度规章,按质、按量、按时完成其本职工作PartyBshallfulfillhisjobinahigh-qualityquantitativeandtime-efficientmannerandabidebyallthepanyrules..合约甲方单位机构可以根据实际工作需要,根据合约乙方单位机构的工作能力和表现,调整合约乙方单位机构工作岗位或安排合约乙方单位机构临时从事其他工作岗位,合约乙方单位机构应予以认可配合PartyAmayadjustPartyBsjoborappointPartyBtodoanotherjobtemporarilybyvirtueofitsbusinessrequirementsaswellasPartyBspetenceandperformance.PartyBshallagreeandcooperatewithPartyA.

四、劳动报酬LaborRemuneration.合约甲方单位机构每月5日前以货币的形式足额支付合约乙方单位机构工资,结算周期为上月月初到上月月末,实行先工作后发薪的规章制度规章PartyAshallpayoffsalarytoPartyBincurrencyonthe5thofeverymonth.Thepayperiodisfromthebeginningtotheendoflastmonth.PartyBworksbeforepaid..在试用期,合约乙方单位机构的税前工资为每月元人民币;在试用期后,合约乙方单位机构薪金模式为工作基本月薪元人民币,加年度奖金模式其中年度奖金根据公司经营状况和合约乙方单位机构工作表现另行确定PartyBsprobationperiodsalaryisRMB.A什ertheprobationperiodPartyBsnormalbasicsalaryisplusannualbonuswhichcanbeadjustedaspertheponysoperationandPartyBsperformance..在合约甲方单位机构取得中国企业营业执照之前,合约甲方单位机构不承担合约乙方单位机构社会保险费用和医疗保险费用;在合约甲方单位机构取得其企业营业执照后,合约甲方单位机构须承担合约乙方单位机构相关社会、医疗保险费用,并按照国家有关规定对合约乙方单位机构所应承担的社会保险费用及个人所得税进行代缴BeforePartyAobtainsitsBusinessLicenseofficiallyPartyAisnotresponsibleforpayingoffPartyBssocialandmedicalinsurance;afterPartyAobtainsitsBusinessLicenseitmustpayrelatedPartyBssocialandmedicalinsuranceandwilldeductPartyBsownsocialandmedicalinsurancepremiumandindividualinetaxfromPartyBssalarytopaytotheChinesegovernment..合约甲方单位机构调整合约乙方单位机构工作岗位的,根据合约乙方单位机构能力及其相关职位,双方协商一致后调整合约乙方单位机构劳动报酬PartyBslaborremunerationwillbeadjustedasperPartyBspetenceandjobrequirementsonthebasisofconsensusincasePartyAadjustPort/Bsjob..合约甲方单位机构将每年对合约乙方单位机构的工作成绩表现,以及劳动报酬进行评估.PartyAwillreviewPartyBsworkperformanceandsalaryonanannualbasis.
五、社会保险和福利待遇SocialWelfareBenefits.合约甲方单位机构根据国家有关规定为合约乙方单位机构缴纳北京市城镇社会保险养老、医疗、失业、工伤,个人缴纳部分由合约甲方单位机构从合约乙方单位机构工资中代扣代缴合约缔结双方解除、终止劳动协议合同协议时,合约甲方单位机构按有关规定为合约乙方单位机构办理社会保险相关手续AccordingtotheStatesrelatedrulesPartyAwillpayBeijingsocialinsuranceinurbanareai.e.pensioninsuranceunemploymentinsuranceOccupationalInjuryandmedicalinsuranceforPartyB.AndPartyAwilldeductPartyBspartfromhisorhersalary.WhenthelaborcontractisterminatedbybothpartiesPartyAwillhandletherelatedproceduresforPartyBssocialinsuranceaccordingtotherelatedregulations..合约乙方单位机构非因工疾病或负伤,在医疗期内工资及其医疗待遇按照本协议合同协议16条执行合约乙方单位机构患职业病或因工负伤后的工资和医疗补助执行按照国家和地方的有关法律法规执行IncaseofillnessesorinjuriesunrelatedtoworkthesalaryduringtheremedialperiodaswellasmedicaltreatmentshallbepaidinaccordancewithClause
16.ThesalaryandMedicarebenefitsofPartyBincaseofoccupationaldiseasesorwork-relatedinjuriesshallbepaidinaccordancewiththerelevantnationalandlocallawsandregulations..因公出差按公司规定实行差旅费报销与补贴IncasePartyBtravelsonbusinessPartyAwillreimbursetravellingexpensesandgivesubsidytoPartyBinaccordancewiththeponyrules.
六、假期安排AnnualLeaveandSickLeave.带薪年假-雇佣期满一年后,合约甲方单位机构每年为合约乙方单位机构提供十天带薪年假合约乙方单位机构需根据合约甲方单位机构经营和工作等实际情况,安排年假,尽量将合约甲方单位机构损失最小化合约乙方单位机构休年假时,必须提前一个月通知合约甲方单位机构,并取得合约甲方单位机构批准,方可休假AnnualLeave-PartyBshallbeentitledtotakepaidannualleaveoften10workingdaysperannumafterthefirstyeartheemployment.Leavemaybetakenasitisaccruedbutmayonlybetakenattimesagreedtobythepanyinorderthatdisruptionwillbeminimal.Requestforleavemustbesubmittedone1monthinadvanceandapprovedbyPartyA..病假-如合约乙方单位机构不涉及住院治疗,合约甲方单位机构将每年批准合约乙方单位机构共计15天带薪病假;其中全薪病假五天,三分之二薪金病假五天,以及三分之一薪金病假五天如合约乙方单位机构病假日期总数超过合约甲方单位机构允许的病假日期总数,超出部分将在合约乙方单位机构带薪年假日期数中扣除;如果合约乙方单位机构病假日期总数超出了合约甲方单位机构允许的病假和带薪年假日期总和,合约甲方单位机构将不会支付合约乙方单位机构超出日期的任何薪金合约乙方单位机构必须向合约甲方单位机构财务或行政部出具医院的相关病假证明并通知合约乙方单位机构上级机构部门机构,如合约乙方单位机构不能提供相关医院病假证明,视为合约乙方单位机构旷工处理,合约甲方单位机构有权不支付合约乙方单位机构旷工期间任何薪金PartyBisentitledtofive5dayssickleaveperfullcalendaryearatfullpaynextfive5dayssickleaveattwo-thirdpayandnextfive5dayssickleaveatone-thirdpayifnohospitalizationisincurred.MedicalCertificatesmustbesubmittedtoourAccounts/Admindepartmentuponreturningtotheoffice;ifnotPartyAhasrightnottopayforPartyBsabsence.PartyBisrequiredtoinformitssupervisorandthedirectorsifPartyBrequiressickleave.AllabsencebeyondPartyBsallocatedsickleaveisdeductedfromitsvacationtime.IfboththesickleaveandvacationleavesareusedupPartyBwillnotbeentitledtobepaidforitstimethatPartyBisabsentfromwork.
七、劳动纪律LaborDisciplines.协议合同协议期间,合约乙方单位机构应严格遵守国家的各项法律法规及合约甲方单位机构依法制定的各项规章规章制度规章及相关要求,严格遵守劳动安全卫生、操作规程及工作规范;应爱护合约甲方单位机构财产,遵守职业道德,积极维护公司荣誉和利益WithinthecontracttermPartyBshallabidebytheStatedlawsandregulationsaswellastherulesformulatedbyPartyAaccordingtothelaws;followlaborsecurityandhygienesystemsproductionprocessesoperatinginstructionsandjobspecifications;takegoodcareofPartyAsproperty;andsafeguardthebenefitsandreputationofthepony..合约乙方单位机构违反劳动纪律,合约甲方单位机构可依据本公司的规章规章制度规章给予纪律处分,直至解除本劳动协议合同协议另外,由于合约乙方单位机构的原因对合约甲方单位机构造成经济损失的,原则上必须按照实际损失金额由合约乙方单位机构向合约甲方单位机构承担损害赔偿责任,数目重大者合约甲方单位机构有权追究其法律责任IncasePartyBviolatesanyofthelabordisciplinesPartyAmaypunishPort/Borevenreleasethecontractaccordingtotherulesandregulationsofthepony.MoreoverPartyBwillbeheldliableforPartyAseconomiclossesonacase-by-casebasisintheeventthatPartyBsbehaviordamagesPartyAsinterests.IncaseoftheconsiderableamountoflossesPartyAwillretaintherighttopursuelegalactionsagainstPartyB..在本协议合同协议履行过程中,合约甲方单位机构根据国家有关规定可以制定新的规章规章制度规章,也可以对公司制定的规章规章制度规章进行修改,发布的各种规章规章制度规章、操作规定、通知、公告等均对合约乙方单位机构有约束力DuringthecontractperformancePartyAmayformulateneworreviserulesandregulationsbasedontheStatesrelatedregulations.TherulesandregulationsoperatingprovisionsnoticesandproclamationsarebindingonPartyB.
八、劳动协议合同协议的履行和变更LaborContractPerformanceAlternation.合约甲方单位机构应按照约定为合约乙方单位机构提供适当的工作场所、劳动条件和工作岗位并按时向合约乙方单位机构支付劳动报酬I合约乙方单位机构应当认真履行自己的劳动职责,并亲自完成本协议合同协议约定的工作任务PartyAshallfurnishPartyBwithproperworkingplacelaborconditionsandpositionandshallalsopaytheremunerationtoPartyBontimeconformingtotheprovisionsherein.PartyBshallfulfillhisresponsibilitieshereininduediligence..甲、乙双方协商一致,可以变更本协议合同协议有关内容,并以书面的形式确定Thecontractmayberevisedinwrittenformafterbothparties1agreementthroughnegotiation.
九、劳动协议合同协议的解除、终止和续订LaborContractCancellcitionTerminationRenewal.经甲、乙双方当事人协商一致本协议合同协议可以解除双方应提前三十日(试用期为提前三日)以书面形式通知对方或以支付一个月工资代替通知,方可解除本协议Thecontractmaybecanceledbasedonbothparties1mutualnegotiation.Eitherpartyintendingtocancelthecontractshallinformtheotherpartyinwrittenform30daysinadvanceProbationperiod:five3daysinadvanceorone1monthsalaryinlieuofthenotice..合约乙方单位机构有下列情形之一的,合约甲方单位机构可以随时解除本协议合同协议严重违反劳动纪律和规章规章制度规章的;严重失职,营私舞弊,给合约甲方单位机构造成重大损失的;合约乙方单位机构没有经过合约甲方单位机构同意,同时与其他用人单位建立劳动关系,对完成合约甲方单位机构的工作任务造成严重影响,或者经合约甲方单位机构提出,拒不改正的;因劳动协议合同协议期满致使本协议合同协议无效的;依法被追究刑事责任或劳动教养的;合约乙方单位机构利用职务之便收受贿赂的或泄漏公司机密造成公司损失的PartyAmaycancelthecontractincaseanyofthefollowingoccurs:PartyBseverelyviolatesthelabordisciplinesandregulations;PartyBsgrossnegligenceorjobberycausesgreatlossesforPartyA;PartyBholdsanotherjobwithoutthepermitofPartyAzwhichseriouslyaffectsthepletionofPartyAsworktaskorPartyBrefusestocorrecttheerrorafterPartyAswarning;Thecontractturnsinvalidduetoexpiration;PartyBisheldcriminallyresponsibleorreeducatedthroughlabor;orPartyBacceptsbribesbytakingadvantageofdutyorcausesthelossoftheponybyvirtueofdivulgingthemercialsecrets..有下列情形之一的,合约乙方单位机构可以随时通知合约甲方单位机构解除本协议合同协议在试用期内的;合约甲方单位机构以暴力、威胁或者非法限制人身自由的手段强迫劳动的;合约甲方单位机构未按照劳动协议合同协议约定支付劳动报酬或者提供劳动条件的PartyBmaynotifyPartyAofterminatingthecontractatanytimeincaseanyofthefollowingoccurs:Withintheprobation;PartyAforcesPartyBtoworkbyviolencethreatorillegallimitationsofPartyBsfreedom.PartyAfailstopayPartyBssalaryorprovideworkconditionsasstipulatedherein..符合下列情形之一的,合约甲方单位机构提前三十日(试用期为提前三日)以书面形式通知合约乙方单位机构或以支付一个月工资代替通知,解除本协议合同协议患病或非因工负伤,在规定医疗期满后,不能从事原工作,也不能从事合约甲方单位机构另行安排的工作的;合约乙方单位机构不能胜任工作,经过调整工作岗位,仍不能胜任工作的;本协议合同协议订立时所依据的客观情况发生重大变更修改,致使本协议合同协议无法履行,经甲、乙双方协商,未能变更本协议合同协议有关内容达成协议的;按照相关法规及程序合约甲方单位机构依法裁员的PartyAmaycancelthecontractuponthirty30dayspriorwrittennoticetoPartyBProbation:three3daysinadvanceorone1monthsalaryinlieuofthenoticeincaseanyofthefollowingoccurs:PartyBzduetosicknessorinjuryinflictedoffthejobcannotresumehisorherworkordotheotherjobreassignedbyPartyAafterspecifiedperiodofmedicaltreatment;PartyBisunqualifiedevenafteratrainingorjobadjustment;Theobjectiveconditionsonwhichthecontractisbasedhavemateriallychangedtotheextentthatitisimpossibletoperformthecontractwhilebothpartiescannotreachanagreementtoamendthecontracttoreflectthechangedconditions;orPartyAdownsizesaccordingtorelatedlawsandprocedures..合约乙方单位机构有下列情形之一的,合约甲方单位机构不得按本协议合同协议第二十五条的约定与合约乙方单位机构解除劳动和同在合约甲方单位机构工作期间患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的;患病或因工负伤,在规定的医疗期间的;女职工在孕期、产期、哺乳期的;法律、行政法规规定的其他情形PartyAisnotallowedtocancelthelaborcontractasperClause25incaseanyofthefollowingoccurs:PartyBisconfirmedpartlyortotallyincapacitatedduetoanindustrialinjuryoranoccupationaldiseasewhenworkingforPartyA;PartyBisinaperiodofmedicaltreatmentforsicknessorworkinjury;Thefemaleemployeeisinpregnancymaternityorlactation;orOthersituationsstipulatedinlawsandadministrativeprovisions..符合下列情形之一的,本劳动协议合同协议即可终止劳动协议合同协议期满;合约乙方单位机构死亡、或者被法院宣告死亡或者宣告失踪的;合约甲方单位机构依法被宣告破产的;合约甲方单位机构被吊销营业执照、责令关闭、撤销或者合约甲方单位机构决定提前解散的;法律、行政法规规定的其他情形Thecontractwillterminateincaseanyofthefollowingoccurs:Thelaborcontractexpires;PartyBisdeadpronounceddeadorpronouncedmissingbythepeoplescourt;PartyAisdeclaredbankruptcylegally;PartyAsbusinesslicenseisrevoked;PartyAispelledtoclosedownordissolve;orPartyAdecidestodissolveinadvance;orOthersituationsstipulatedinlawsandadministrativeprovisions.
十、赔偿责任、违约责任pensationfortheBreachorCancellcitionoftheContract.合约乙方单位机构造成直接损失的赔偿金赔偿金按合约乙方单位机构实际造成的损失计算,赔偿金的范围包括合约乙方单位机构损坏合约甲方单位机构财物而导致的直接经济损失;合约乙方单位机构疏忽导致的合约甲方单位机构直接经济损失;合约乙方单位机构拒绝合理的工作安排而导致合约甲方单位机构经济损失IncasePartyBsbehaviorcausesthelossesofPartyAthepensationamountiscalculatedbasedontheactuallossescausedbyPartyB.Thepensationincludes:ThedirecteconomiclossescausedbyPartyBsdamagesofPartyAsproperty;ThedirecteconomiclossesresultingfromPartyBsnegligence;andTheeconomiclossesduetoPartyBsrejectionofthereasonableworkassignedbyPartyA..合约缔结双方任何一方违反本协议合同协议,给另一方造成经济损失的,根据违约责任大小,需承担违约责任Incasethateitherpartybreachesthecontractorcausestheeconomiclossesoftheotherpartythedefaultpartywillbeheldliableforbreachofcontractonacase-by-casebasis..合约乙方单位机构不得在任何情况下将合约甲方单位机构的保密资料、数据、运营模式、工具等直接或者间接泄露给任何第三方,如经合约甲方单位机构发现按合约甲方单位机构损失大小赔偿InanycasePartyBshallnotdirectlyorindirectlydivulgethemercialsecretsincludingbutnotlimitedinformationdatamanagementmodelsandtoolsofPartyAtoanythethirdparty.IncasePartyBisfoundtodivulgethemercialsecretsbyPartyAzPartyBshallpensatePartyAforthelossofaccordingtotheextent..如果合约乙方单位机构接受了合约甲方单位机构提供的培训I和/或教育资助,并且合约乙方单位机构在其同意的为合约甲方单位机构服务的期限自培训结束之日起计算内解除本协议合同协议合约乙方单位机构应在本协议合同协议终止十二个月内向合约甲方单位机构赔偿合约甲方单位机构给予合约乙方单位机构的培训I和/或教育资助IncasePartyBisgrantedtrainingand/oreducationfinancialaidfromPartyAandifPartyBterminatesthisContactbeforethetermfromthepletiondateofthetrainingduringwhichPartyBhasagreedtoservePartyAPartyBshallpensatePartyAforincurredtrainingexpensesand/oreducationfinancialaidgrantedtoP什yBbyPartyAoverthetwelve12monthsperiodfollowingtheterminationofthisContract.
